Court Ruling Clears the Way for Matric Results Publication

    The North Gauteng High Court recently dismissed the Information Regulator’s application to block the publication of matric results, allowing the Department of Basic Education (DBE) to proceed with the usual release of results using candidate numbers while keeping students’ full names private.

    Information Regulator Disappointed but Not Over

    Despite the court’s decision, the Information Regulator (IR) has expressed disappointment, stating that the legal dispute is far from over. The IR maintains that the publication of personal information through results is still not lawful, and any appeal will be closely monitored to ensure compliance with privacy laws.

    Parliament Urges Focus on Students’ Well-being

    Amid the legal battle, Parliament has called on both the IR and DBE to prioritize the emotional and psychological well-being of matric students. Joy Maimela, chairperson of the Portfolio Committee on Basic Education, emphasized the importance of reducing anxiety among students during this time.

    AfriForum Welcomes Court Decision

    AfriForum, which represents many matriculants, welcomed the court’s judgment, stating that publishing exam numbers provides sufficient privacy protection. They highlighted that students or their parents can consent to have their results made public, ensuring better control over privacy.

    Legal Matters Should Have Been Resolved Earlier

    Dr. Anthea Cereseto from the Governing Body Foundation pointed out that this issue should have been resolved after the 2022 court ruling, which allowed the publication of results with exam numbers. She stressed that consent is already implied when students enter exams, though ensuring compliance with legal standards remains an ongoing concern.
