Legal Battle Looms Over South Africa’s Cannabis Regulations
The South African government’s recent ban on hemp and cannabis in food and cosmetic products has sparked outrage among cannabis growers and entrepreneurs. The new regulation, signed by Minister of Health Aaron Motsoaledi, prohibits the sale, manufacture, or import of any foodstuff containing cannabis, hemp seed oil, or hemp-derived powder. Violators could face fines or imprisonment.
Legal Battle Against the Ban
Hennie Venter, CEO of Cannabisness and managing director of HempCare, is leading the charge against the government’s decision. He, along with other cannabis business owners, has sent a formal request to Minister Motsoaledi, demanding the reversal of the law. However, with no response from the health minister, the group is now preparing for a court battle.
“We have given the minister seven days to respond, and since they failed to do so, we are moving forward with litigation,” Venter stated. He emphasized that the ban is putting millions of rands in investment at risk, crippling businesses that have already spent years developing cannabis-based products.
Entrepreneurs Call Ban ‘Unconstitutional’
Cannabis industry stakeholders argue that instead of imposing a blanket ban, the government should regulate the industry to ensure safe and legal use. Ruvekh Singh, director of BakedPMB, called the government’s actions unconstitutional.
“Instead of banning the substance, they should create a regulatory framework to support the industry,” Singh said.
The cannabis sector has been seen as a growing contributor to the South African economy, with potential job creation and export opportunities. However, the ban could push businesses underground, limiting legal trade and innovation in the industry.
What Happens Next?
With legal proceedings underway, cannabis and hemp entrepreneurs are rallying to challenge the validity of the regulations and claim financial losses. The Department of Health has yet to provide an official response regarding the lawsuit.
As the battle over cannabis regulations intensifies, many are questioning whether South Africa is missing an economic opportunity by restricting its cannabis industry rather than fostering its growth.
