#JusticeForCwcwe: In a huge twist of events, the Eastern Cape Department of Education has withdrawn its decision to deregister Bergview College in Matatiele, following legal challenges and public outcry over the alleged assault of a seven-year-old pupil.

    Background of the Incident

In October 2024, a seven-year-old girl, affectionately known as “Cwecwe,” was allegedly assaulted on the premises of Bergview College while awaiting transportation home. The school’s handling of the situation, including accusations of non-cooperation with law enforcement and failure to support the victim’s family, led to widespread public outrage and the emergence of the #JusticeForCwecwe movement.

    Initial Decision to Deregister

Amid mounting pressure, Eastern Cape Education MEC Fundile Gade announced plans to deregister Bergview College, citing the school’s failure to provide a safe environment and its non-compliance with standards for independent schools. The department also highlighted the school’s alleged lack of cooperation with law enforcement during the investigation.

    Legal Challenge by Bergview College

In response, the trustees of the Wizkid Trust, which operates Bergview College, filed an urgent application before the High Court in Makhanda to challenge the deregistration. They argued that the decision was unlawful and arbitrary, asserting that the Schools Act requires authorities to allow the school an opportunity to make representations before such action is taken.

    Reversal of Deregistration

Following the legal challenge and consultations with the justice system, the Department of Education rescinded its decision to deregister the school. Department spokesperson Vuyiseka Mboxela stated that the department was convinced the matter was receiving the attention it deserved and emphasized concerns about the potential displacement of approximately 600 learners if the school were to be closed.

    Ongoing Investigations and Public Reaction

The withdrawal of the deregistration notice has elicited mixed reactions. Supporters of the #JusticeForCwecwe movement express concern that this decision might undermine efforts to hold the school accountable. Conversely, some believe that continued oversight and engagement with the school could lead to more constructive outcomes. The Department of Education has pledged to continue monitoring the situation closely to ensure the safety and well-being of all students.

    Looking Ahead

As the situation evolves, it remains crucial for the Department of Education to balance regulatory actions with the best interests of the students. Ensuring that Bergview College adheres to safety standards and cooperates fully with ongoing investigations will be paramount in restoring public trust.
