Chidimma Adetshina’s mother, Anabela Rungo, was granted bail on Wednesday but has been placed under strict house arrest conditions by the Cape Town Magistrate’s Court. The court ruling follows charges against her for allegedly contravening South Africa’s Immigration Act and the Identification Act.
Strict Bail Conditions for Anabela Rungo
During the bail hearing, the State argued that Rungo posed a flight risk and could potentially re-offend. Despite these concerns, Magistrate Sadiqah Guendouz granted her bail set at R10 000. However, she ruled that Rungo would only be allowed to leave her residence for legal consultations or court appearances. This decision led Rungo to break down in tears in the courtroom.
Further restrictions were imposed, including a prohibition on applying for residency permits or engaging with the Mozambican and Nigerian embassies, either personally or through a representative. The case has been postponed to 8 May for further investigation.
Magistrate Guendouz Faces Recusal Attempt
Earlier in the proceedings, the State sought to have Magistrate Guendouz recused from the case, arguing that she had prior knowledge of the matter before Rungo’s arrest. However, Rungo’s defense countered that there were no legitimate grounds for her removal. Guendouz ultimately dismissed the recusal request, stating that the State had insufficient reasons for making such an application.
“This court could easily recuse itself. What has unfortunately become blatantly embarrassing for the State is that it’s going to find everybody discussed it [the matter] in September. It was the thing that was all over, it was not over yet… Those grounds are not enough,” she said, according to News24.
The Arrest and Immigration Fraud Allegations
Anabela Rungo, a Mozambican national, was arrested earlier this month after an investigation by the Department of Home Affairs found evidence of fraudulent activity related to her citizenship. The investigation, launched in August last year, revealed that Rungo’s South African identity documents had been obtained unlawfully, leading to their revocation in September.
According to Home Affairs spokesperson Siya Qoza, the discovery rendered Rungo ineligible to remain in South Africa. Her subsequent arrest has drawn significant public attention, given her connection to Chidimma Adetshina.
