New Evidence Found in AKA Murder Case

The tragic murder of Kiernan “AKA” Forbes, the celebrated South African rapper, and his friend, celebrity chef Tebello “Tibz” Motsoane, continues to grip the nation as new developments unfold in court. The high-profile murder case has taken another dramatic turn, with the State presenting fresh evidence against one of the accused during a bail application hearing.

Renewed Bail Applications Denied

Mziwethemba Harvey Gwabeni and Lindokuhle Ndimande, two of the seven men accused in the murder case, recently filed a Notice of Motion at the Durban Magistrate’s Court. The motion, based on what the defense claims to be “new facts,” sought to secure their release on bail.

In their submissions, both men cited financial hardship and the inability to provide for their families as reasons for bail. Gwabeni mentioned letters from his children’s schools regarding outstanding fees and emphasized his role as the family breadwinner. Similarly, Ndimande argued that his continued incarceration was causing severe distress to his family and preventing him from adequately consulting with his legal team to prepare for trial.

However, the State opposed these claims, stating that the so-called “new facts” were not substantial or relevant enough to warrant bail.

CCTV Evidence Places Accused at Durban Airport

The State bolstered its argument against granting bail by presenting new evidence. CCTV footage reportedly places Gwabeni at Durban’s King Shaka International Airport on the day AKA arrived in the city.

According to the State, Gwabeni can be seen walking a short distance behind AKA and his entourage at the airport. The footage also shows Gwabeni making a phone call to his co-accused, Lindani Zenzele Ndimande, during the same time frame.

Further surveillance footage captured Gwabeni trailing AKA to the car hire offices, where he remained for a short period while still on the phone. The State alleges that this behavior demonstrates a pattern of surveillance, as Gwabeni reportedly followed AKA from the airport to the hotel where he was staying.

This evidence challenges previous claims by the defense that the State lacks substantial evidence to support the charges against the accused.

Background on the Case

AKA and Tibz were tragically gunned down outside Wish, a popular restaurant in Durban, in February 2023. The murders sent shockwaves through South Africa, sparking widespread speculation and public outcry for justice.

Seven men were arrested in connection with the murder case, but the investigation has been fraught with challenges, including claims of insufficient evidence and delays in court proceedings.

Defense Arguments Fall Short

In their submissions, Gwabeni and Ndimande argued that their prolonged detention amounts to “anticipatory punishment.” They contended that the lack of significant progress in transferring the case to a Regional or High Court undermines the justification for their continued incarceration.

“My detention is a form of anticipatory punishment as the State does not have strong evidence to sustain the charges against me,” Ndimande stated. He added that being released on bail would allow him to raise funds for his legal defense and prepare adequately for the trial.

Despite these claims, the State dismissed their arguments, asserting that the financial and familial hardships cited by the accused are not exceptional circumstances.

Public and Legal Implications

The revelation of CCTV footage has reignited public interest in the case, with many expressing hope that justice will be served. However, the bail appeal drama also underscores the complexities of the South African legal system, where the balance between upholding justice and ensuring fair treatment of suspects remains a delicate issue.

As the case progresses, questions persist about the strength of the evidence, the motivations behind the crime, and the potential involvement of other individuals.
