The AmaZulu King, Misuzulu kaZwelithini, finds himself at the centre of a heated governance dispute over the Ingonyama Trust. This entity, which oversees communal land in KwaZulu-Natal, has been entangled in controversies surrounding the roles, powers, and accountability of its key stakeholders.

Suspensions and Power Struggles

Vela Mngwengwe, the suspended CEO of the Ingonyama Trust Board, revealed concerns about King Misuzulu’s interpretation of his authority as the trust’s sole trustee. Mngwengwe alleged that the king believed he could make unilateral decisions without oversight, sidelining the board’s statutory role.

The dispute escalated in December 2024 when King Misuzulu suspended Mngwengwe and six board members, citing governance issues. However, Land Reform and Rural Development Minister Mzwanele Nyhontso challenged this decision, reinstating the members and accusing the king of acting beyond his legal powers.

Allegations of Mismanagement

Mngwengwe accused the king of attempting to bypass the board on several occasions. One such instance involved appointing attorneys without the board’s knowledge to investigate financial matters related to Ingonyama Holdings, a subsidiary of the trust.

Further claims included the king’s alleged unilateral appointment of a board secretary and efforts to secure funding for personal legal battles from the trust. Mngwengwe emphasized that these actions violated the Public Finance Management Act (PFMA) and the Ingonyama Trust Act.

A Question of Legal Authority

At the heart of the conflict is a fundamental disagreement about the king’s fiduciary role. Mngwengwe maintained that the Ingonyama Trust is governed by statute, limiting the powers of the sole trustee. He stated:

“The king misunderstands his role. The trust is not a discretionary entity; it operates within strict statutory guidelines.”

Despite his position as trustee, the king is not directly accountable to Parliament, unlike the board, which reports through the minister.

Financial Misconduct Accusations

The trust has also faced allegations of financial irregularities, including the unaccounted sale of a farm worth R23 million. Mngwengwe denied these claims, labelling them as baseless and politically motivated.

A Call for Mediation

King Misuzulu defended his actions, arguing that his fiduciary duties necessitated decisive interventions to uphold the trust’s governance. He has called for an urgent meeting to address the escalating tensions with the board and the minister.

Historical Context

The Ingonyama Trust, established in 1994, was designed to preserve communal land under the custodianship of the Zulu monarchy. However, its management has often been scrutinized for alleged governance failures and lack of transparency.

The ongoing discord between King Misuzulu, the Ingonyama Trust Board, and government officials underscores the complexities of balancing traditional authority with statutory governance. As the matter unfolds, it highlights the need for clear legal frameworks and constructive dialogue to ensure accountability and the trust’s effective operation.
