Senzo Meyiwa Murder Trial: Defence Lawyer Thulani Mngomezulu Passes Away
SABC News
SHARE

The Senzo Meyiwa murder trial, which has captivated the nation and garnered attention from both local and international media, has taken another somber turn with the passing of one of the defence lawyers, Advocate Thulani Mngomezulu. The tragic news was confirmed by his family on December 10, 2024, leaving many in shock. Mngomezulu had been representing accused number 1, Muzikawukhulelwa Sibiya, in the highly publicized case.

A Life Cut Short

Advocate Mngomezulu passed away in the early hours of December 10 at Thelle Moroerane Hospital in Vosloorus, East of Johannesburg. His family released a heartfelt statement, expressing their grief and urging the public to keep them in their prayers during this challenging time. The family described Mngomezulu as a beloved husband, father, and son, and his untimely death has left a deep void.

“In this time of grief, we ask for your compassion, space, and time to congregate as a family to decide on the upcoming days. We thank you for the love and support in advance and ask that you continue to keep us in your prayers,” the family’s statement read.

Mngomezulu had joined the Senzo Meyiwa murder trial in October 2023, during a trial-within-a-trial phase. His role as a defence attorney was critical in challenging the prosecution’s case and ensuring that the accused received a fair trial. At the time of his death, he was preparing to cross-examine Brigadier Bongani Gininda, the lead investigator in the case, a critical moment in the trial that will now have to proceed without him.

Concerns for Safety and Threats to Mngomezulu

Mngomezulu had previously expressed concern for his safety during the course of the trial. In April 2024, he had informed the Gauteng High Court about a disturbing trespassing incident at his home. According to Judge Ratha Mokgoatlheng, Mngomezulu suspected that the trespassing was linked to his role in the Senzo Meyiwa trial. Two unknown individuals had attempted to enter Mngomezulu’s premises in the early hours of the morning. Fortunately, the dogs on the property alerted him to the situation, preventing any potential harm.

Mngomezulu believed that the individuals’ intentions were to harm, injure, or possibly kill him. The judge, alarmed by the lawyer’s safety concerns, indicated that Mngomezulu was entitled to police protection, urging him to file a report with the authorities. This incident highlighted the intense pressures and potential dangers faced by those involved in such high-profile cases in South Africa.

The Senzo Meyiwa Murder Case

Senzo Meyiwa, a former Orlando Pirates goalkeeper and national football team star, was tragically shot and killed on October 26, 2014, while visiting his girlfriend, Kelly Khumalo, at her family home in Vosloorus. The circumstances surrounding his death have remained clouded in mystery and controversy for years. Meyiwa was reportedly shot during what was said to be a botched robbery. However, various accounts and allegations have suggested that the incident could have been a hit, with Meyiwa’s killing potentially linked to a range of personal and criminal motives.

Five men are currently on trial for the murder of Meyiwa: Muzikawukhulelwa Sibiya, Bongani Ntanzi, Mthobisi Mncube, Fisokuhle Ntuli, and Mthokoziseni Maphisa. All five men have pleaded not guilty to charges including premeditated murder, attempted murder, armed robbery, illegal possession of firearms, and illegal possession of ammunition.

Among the most contentious elements of the trial has been the involvement of several prominent figures, including Chico Twala, a well-known music producer. Twala has publicly denied any involvement in the case, though his son, Longwe Twala, was allegedly at the scene of the crime. The defence has also indicated that it plans to call Longwe Twala to testify in court if the state does not do so, adding another layer of complexity to the case.

The Impact of Mngomezulu’s Death on the Trial

Mngomezulu’s sudden passing has undoubtedly created a ripple effect in the trial. The defence team, which had been relying on his legal expertise, will now have to adjust to the loss of a key figure. While it remains to be seen how this will affect the defence’s strategy, it is clear that his contributions were significant, and his absence will be felt by both his clients and colleagues alike.

In a trial that has been marked by numerous delays, procedural battles, and controversial statements, the loss of Advocate Thulani Mngomezulu adds yet another layer of tragedy to an already heartbreaking case. His passing serves as a reminder of the human toll that such high-profile trials can have on all involved, from the accused to their legal teams and the families of those seeking justice.

A Call for Justice

As the trial continues, the family of Senzo Meyiwa and the public at large remain hopeful that justice will be served. Despite the challenges, the court proceedings must continue, as the nation watches closely for answers surrounding the circumstances of Meyiwa’s untimely death.

The Meyiwa family, as well as the wider South African public, remain steadfast in their pursuit of justice for the late footballer, hoping that the legal system will ultimately deliver the answers they have been seeking for nearly a decade.
