The Joburg engineering company at the center of this controversy is NJM Heat and NDE Services, a firm that specializes in various engineering services. They are accused of manipulating the tender process, which involved falsifying documents and providing misleading information to win contracts. The 6 directors misrepresented themselves to Eskom and Sasol by submitting fraudulent tenders for the supply of goods and they also violated the Broad-Based Black Economic Empowerment (B-BBEE) Act by falsely claiming to have a valid shareholders agreement.

The scale of the fraud is staggering, with the total value of the contracts in question amounting to R400 million. This case not only raises questions about the ethical practices of the individuals involved but also highlights broader issues within the public procurement system in South Africa.
